Police Officer Struck By Suspected Drunk Driver

Posted on February 9th, 2009 2 Comments

A California police officer was struck by a suspected drunk driver on Friday.  The officer, whose name has not yet been released, was pinned between two patrol cars during the collision.

The alleged dunk driver is Jennifer Brown, 55, of Folsom, California.  Brown was placed under arrest for suspicion of felony driving under the influence.  Tests showed she had more than twice the allowed limit of alcohol in her blood.

The incident occurred as part of a routine traffic stop. Two patrol cars had another individual pulled over on the highway shoulder, when one of the officers saw Brown's vehicle approaching.  The injured officer jumped between the two patrol cars to avoid Brown, but was pinned between them when Brown struck the rear cruiser.

The officer sustained injuries to his leg and hip but is believed to be in stable condition.

State Trooper Sues Over Taser Injury

Posted on February 9th, 2009 2 Comments

A Massachusetts State Trooper who experienced pain and suffering as a result of Taser use is suing the makers of the device. James Foley has filed a $1 million lawsuit against the company, after attending a 2006 Taser seminar for law enforcement officials, at which time represntatives from the company demonstrated the device on him.

The injury stems from the fact that a previous injury left Foley with surgical hardware in one of his legs, including a surgical screw.  Foley said he warned the Taser employees at the seminar of this fact, but they told him not to be concerned and demonstrated the device on him anyway.  As a reuslt, the charge of the Taser bent one of the screws and caused multiple fractures in Foley's leg, according to the lawsuit.

The previous injury occurred in 2004, when Foley's police car was struck by a sport utility vehicle while on the job.

Foley is currently back on the job, but the lawsuit remains unresolved.

Workers' compensation law varies from state to state.  Philadelphia has
its own set of laws that require an experienced individual to handle
any case dealing with workers compensation. If you or someone you know has been injured at
work, it is important that you understand the workers' compensation rights available under the law.

Following Workers’ Comp Claim, Mayor Forbids Firefighters From Using Exercise Equipment

Posted on February 6th, 2009 1 Comment

The mayor of Berwyn, Illinois has prohibited the use of firehouse exercise equipment, due to concerns about potential workers' compensation claims.  The move follows the injury of firefighter Stephen Petergal, who suffered a hernia while working out on a firehouse treadmill last November.

Berwyn Mayor Michael O'Connor said that the action was taken as the result of an overall rise in workers' compensation claims against the city.  He added that the city has paid a total of $6 million in workers' compensation claims since June of 2004.

Petergal ultimately required surgery due to the hernia.  He said he
filed a workers' compensation claim because he believed that his health
insurance would otherwise not cover his injury.

Berwyn Fire Chief Denis O'Halloran said that not allowing firefighters to use the equipment at work has affected firehouse morale.  He also claimed that a lack of regular excercise could lead to even more injuries among firefighters.

The firefighters union has filed a grievance against the city as a result of the exercise ban.  The issue will now go into arbitration for a possible resolution.

If you've been injured at work, it is important that you understand your legal rights regarding workers' compensation claims. Contact the Philadelphia workers' compensation lawyers of Lowenthal & Abrams, P.C. at 610-667-7511 for more information.

Company’s Exercise Program Aims to Reduce Workplace Injuries

Posted on February 6th, 2009 No Comments

A Kansas company has taken the unique step of establishing a
daily stretching exercise program in order to reduce the prevalence of
workplace injuries.  Construction firm
UCI now requires all employees to participate in the program, which begins each
morning at 7:30 a.m.

Workplace injuries are common in the construction industry,
but UCI says their program has helped to substantially reduce their
occurrence.  The company has even drawn
praise from the U.S. Occupational Health and Safety Administration, which has
awarded them a special Voluntary Protection Program designation.

UCI says that workplace safety has always been a part of
their corporate culture, but the stretching program has enhanced this culture even
further and produced tangible results.  The
potential cost of workplace accidents to companies like UCI can be substantial,
even for injuries like ankle sprains.  In
addition, reducing the prevalence of workplace injuries leads to lower corporate
insurance premiums.

No matter how many precautions an employer may take, it is
impossible to completely eliminate the possibility of a workplace injury.  Fortunately, there are laws in place to
protect employees in these situations.  If
you or someone you know has had an accident while on the job, contact the Philadelphia workers' compensation lawyers of Lowenthal & Abrams, P.C.

Surprising Group of Philadelphia Workers Claims the Most Workers’ Comp Injuries

Posted on January 22nd, 2009 1 Comment

When you think of all of the potentially dangerous jobs out there, you might first think of the difficult conditions and situations that firefighters, policemen, and even construction workers are put in every single day. While these occupations undoubtedly place the workers at risk for a variety of injuries, they were not the group of workers who claimed the most in workers' compensation injuries over the last four years. Suprisingly enough, this group of workers is none other than the Philadelphia Parking Authority.

According to several sources, the Philadelphia Parking Authority is estimated to have collected around $5.8 million in workers' compensation injuries over the last four years, which is almost double the amount was collected by Philadelphia police officers.

Parking Authority workers do, in fact, have a rough job and are often required to preform tasks that can strain workers both physically and emotionally. However, the high number of injuries reported has caught the attention of the authority official responsible for processing the claims. He admits that the number seems unusally high and an investigation into the validity of the claims has been initiated.

If you've been injured at work, you may be eligible to file a workers' compensation claim. Contact the Philadelphia workers' compensation lawyers of Lowenthal & Abrams, P.C. at 610-667-7511 for more information.
