How soon should you file a workers’ compensation claims?

When employees suffer workplace injuries, they are often eligible to receive workers’ compensation benefits. However, they must report the injury and make a filing within certain time periods.

After the injury occurs, employees have 120 to let their employer know about the injury, and they have 3 years to file a claim petition for workers’ compensation benefits. Not meeting these requirements could jeopardize employees’ chances of receiving workers’ compensation benefits.

Under the Workers’ Compensation Act, almost all Pennsylvania workers are covered for workers’ compensation benefits. This means that they cover some or all of the costs of treatment related to workplace injuries.

This provision even applies to businesses with few employees in most cases. The only case in which an employee may not be covered is if the individual is self-employed.

CIGNA Adds Health Team

CIGNA Onsite Health has brought health and wellness training to the workplace by adding health company Kronos to its program. Kronos specializes in health education programs, coaching, screenings and lifestyle programs. It hopes to prevent workplace accidents by training individuals how to improve their health.

The company says that many of the most prevalent causes of death, injury and illness at the workplace are largely preventable. They hope to make this process more cost-effective and convenient for employers as well as decrease medical costs for companies. Companies with effective programs like this are shown to have lower levels of absenteeism and disability or injury costs.

Cousin Shot in Workers’ Comp Conspiracy

A Philadelphia man staged a robbery and shot his cousin in a conspiracy to gather workers' compensation insurance in 2002. The 46-year-old pleaded guilty more than a week ago and was given a five-year suspended sentence and 18 months probation for a single count of conspiracy to commit insurance fraud.

The man and his cousin planned the fake armed robbery in a plan to file for workers' comp from the cousin's employer, United Parcel Service (UPS). During the robbery, as part of the plan, the man shot his cousin in the right leg. Liberty Mutual Insurance paid the cousin $250,000 two years later, some of which he shared with his co-conspirator. A former friend reported the fraud. The cousin confessed they got the idea from television.

According to a study conducted by the Pennsylvania Worker's Compensation Research Institute, the average costs and expenses per claim for workers' compensation claims have risen steadily over the past 12 months. In addition, the average payments-per-claim have shown a 7 percent increase since 2007. The study examined costs-per-claim when the injury resulted in more than seven days of lost work-time for the individuals involved.

Ex-Official Claims Work-Related Stress Led to Worker’s Compensation Claims

A former Deputy-Warden testified recently he should be eligible for payments from the Wilkes-Barre worker's compensation fund, because he suffered serious health issues due to work-related stress. The former official claimed he suffered "blackout" episodes and extreme anxiety and panic attacks as a result of the pressures of his job. Sources say that the official was laid-off last week, and was allowed to remain on the payroll from August to January because he had unused sick and vacation time.

Worker Amputation Results in Heavy Fine for PA Employer

The United States Occupational Safety and HealthAdministration (OSHA) has cited Emanual Tire of Pennsylvania for workplacesafety and health violations. OSHA has proposed $51,650 in penalties followingan investigation of an injured worker.

OSHA began investigating the company on March 25 after aworker suffered an amputation during a workplace accident. The investigationfound 38 serious violations with a cumulative penalty of $50,750 as well asthree minor violations totaling to $900.

The serious violations include a lack of handrails on industrialstairs, failure to prohibit workers from riding on a conveyor, failure todevelop energy control and hazard communication programs, unguarded machineryand inadequate training.

Jean Kulp, area director of the OSHA office in Allentown,Pa. says that “Without proper machine guarding, Emanual Tire will continue tobe at risk of future workplace accidents… It is imperative that the companyabate all identified hazards as soon as possible.”

Worker Crushed to Death by Tanker

A worker in the Dallas area died on Monday in a work related accident.  The accident happened just before noon.  The man was killed while sweeping an area, and then a large tanker weighing several tons fail on him.  The worker died immediatly from the force of the tanker.

 The man was discovered by another co-worker who called 911 and reported the emergency.  The worker then used a fork lift to raise the tanker off the man's body. The accident is currently under investigation right now as authorities hope to figure out how this happened.

Construction Worker in Serious Condition After Electrocution

A Florida construction worker was seriously injured on Thursday, after being shocked by electrical wiring while drilling a well.  Authorities say the man was being lowered on a crane platform when the crane operator apparently failed to notice live electrical wires in its path.

Firefighters arriving on the scene said the worked sustained serious injuries.  He was transported by helicopter to an area hospital.  His identity has not yet been disclosed.

As a result of the accident, power company officials briefly shut off electricity in the immediate vicinity.  Aside from the electrocuted worker, there were no other reported injuries at the scene.

Heroic Postal Worker Loses Job After Car Crash

Idaho mail carrier Isaac Fish has lost his job with the U.S. Postal Service, following an incident in which his delivery truck crashed on an icy roadway.  Prior to the crash, Fish had been dubbed a hero for his efforts to rescue an ailing elderly woman on his mail route.

Fish, 21, was a temporary postal employee working under a yearly contract with the USPS.  The Postal Service has opted not to renew Fish's contract, and his father has told reporters that this comes as a direct result of the crash.  Fortunately, Fish was not harmed in the incident, and there were no other vehicles or individuals involved.

Postal employees say that USPS policy mandates letting go any temporary employee involved in an car crash. However, Fish and his family criticized the policy, saying that this was the first safety incident Fish had been involved with during his three years on the job.

Fish received local attention last month after helping to rescue Eugenie Simons, a senior citizen who had been immobilized after a fall.  Fish noticed that her mail had gone uncollected for several days and alerted authorities.
