Office job causes woman’s death, husband files for workers’ comp

A New Jersey appeals court recently approved a workers’ compensation claim filed by the husband of a woman who died from a blood clot she developed while working for AT&T.  The woman’s former employer appealed the filing, arguing that factors unrelated to her job caused the blood clot.

The 25-year old woman’s work for AT&T involved several hours in a row of sitting at a desk and working on a computer.  The woman developed a blood clot in her leg which moved to her lung and killed her.  The night that the clot formed, the woman was working long hours overnight to finish a project for AT&T.

The other factors AT&T claimed led to her death included obesity, a sedentary lifestyle, and taking birth control pills.  Despite these factors, the court felt that the sedentary nature of her job was what caused the blood clot to form.

PA DOL sentences 5 for workers’ comp violations

This week, the Pennsylvania Department of Labor and the Industry Bureau of Workers’ Compensation announced that they are sentencing five employers for workers’ compensation violations.  The five employers were from T&T Contracting, D&A Lawn and Landscape Services, LLC and three businesses that had already closed by the time they were issued citations.

The five employers were sentenced to time in the Accelerated Rehabilitative Disposition program.  The program is for first-time workers’ compensation offenders.  The T&T owner was also sentenced to 2 years of probation, 15 hours of community service and a $14,604 fine.  The owner of D&A in Bernville was fined $6,500 after pleading guilty to the violations.

Trench collapse buries construction worker alive

Earlier this month, a tragic construction accident took the life of 20-year old Pennsylvania construction worker Jory Raber III.  The accident occurred at a construction site in Newberry Township, Pennsylvania on Old Trail Road on December 14th.

Officials from the Occupational Safety and Health Adminstration are investigating this fatal construction accident to determine what went wrong.  According to witness reports, a trench collapsed on two workers at the site.  Raber was buried in a hole between 15 and 20 feet deep for 12 hours before rescue crews could get to him.  Another worker was trapped in the collapsed trench up to his waist in dirt.

When paramedics were able to free Raber he had already passed away.  After being freed, the other worker was transported via helicopter to Hersey Medical Center for unspecified injuries.

Gov. Rendell vetoes workers’ comp bill for firefighters

Last month, Governor Rendell vetoed a bill that would allow firefighters diagnosed with certain types of cancer to receive workers’ compensation benefits.  The bill had been fought for by firefighters and The Pennsylvania Professional Firefighters Association.

Rendell said that he vetoed the bill because he felt that it could lead to any firefighter with cancer to claim workers’ compensation.  In addition, Rendell said that the Pennsylvania State Association of Township Supervisors also opposed the bill and that it would be extremely costly for state municipalities.

Also, the governor said he feared that the cost of giving workers’ compensation to firefighters would actually reduce safety because it would mean municipalities cutting costs from other areas.

NY first to extend benefits to domestic workers

On Monday, New York became the first state in the country to require workers’ compensation and disability benefits to domestic workers.  The state defines a domestic worker as one that works in the home doing housekeeping, caring for a child, elderly or sick person or providing another domestic service.  Domestic workers cannot be employed by an agency other than the family of the home and cannot be a relative through blood, marriage or adoption.

The Domestic Workers’ Bill of Rights was approved by Governor David Paterson on August 31st and took effect this Monday, November 29th.  Under the law, employers of domestic workers are required to provide employees with workers’ compensation and disability insurance.  In addition, domestic workers in New York are now subject to the state’s labor laws including a $7.25 minimum wage and 8-hour work day.

Bucks County business joins SHARP

Ziamatic Corp., a fire prevention product supplier out of Bucks County, was recently awarded SHARP status by the Occupational Safety and Health Administration.  SHARP stands for the Safety and Health Achievement Recognition Program and recognizes small private businesses that have shown exceptional safety and health standards in OSHA inspections.

Only 43 Pennsylvania businesses have SHARP status and Ziamatic is the first out of Bucks County.  The award allows Ziamatic to be exempt from OSHA inspections for two years.  Company President Michael P. Ziaylek stated, “Having a safe work environment creates a better morale among our employees.  They know that we as a company have their safety as one of our top priorities”.

BAE Systems employee killed in workplace accident

Earlier this month, a BAE Systems employee passed away from injuries he sustained in a tragic workplace accident at the company’s defense plant in West Manchester Township.  The accident occurred on October 12th and 63-year old Dale Lentz died five days later at York Hospital.

Lentz, a maintenance worker for BAE, was operating a lift similar to a cherry picker to repair an overhead garage door.  At around 7:25 A.M. a co-worker found him unconscious, crushed between the door and the lift.  Federal investigators from the Occupational Safety and Health Administration are investigating what caused him to become trapped.

Lentz was transported to York Hospital for head and brain injuries he suffered in the accident.

Gov. Rendell signs construction classification act

On October 13th, Governor Rendell signed into law the Pennsylvania Construction Workplace Misclassification Act in order to make sure workers are not misclassified in the construction industry.  The act creates an established criteria to classify workers in the construction industry and penalties for employers who incorrectly classify their employees.  The act amends both the Pennsylvania Unemployment Compensation Law and the Pennsylvania Workers’ Compensation Act.

The new law defines construction as the “erection, reconstruction, demolition, alteration, modification, custom fabrication, building, assembling, site preparation and repair work done on any real property or premises under contract, whether or not the work is for a public body and paid for from public funds”.

OSHA fines painting business in death of employee

The U.S. Occupational Safety and Health Administration is fining Modern Painting & Decorating of Springdale $57,900 for the workplace accident that resulted in the death of a former employee.

In April, 48-year old Paul Thompson of Pittsburgh was painting a building for Habitat for Humanity under contract with Modern Painting when he was hit by falling electrical wires and electrocuted.

OSHA is fining the painting company for letting Thompson work too close to the dangerous electrical wires and for other citations of not protecting employees from falls.  Modern Painting & Decorating has 15 days to appeal the fines.

Montana worker killed in tragic accident

A worker subcontracted to work on a $230 million improvement project of the Rainbow Dam in Great Falls, Montana was killed in a tragic construction accident earlier this month.

On September 7th around 8 AM, a 44-year old man was walking between two large trucks.  As the trucks were passing each other they crushed the man.  Emergency medical services officials transported the victim to Benefits Health Systems where he later passed away due to major internal injuries.

The U.S. Occupational Safety and Health Administration is investigating the accident.
