This week, the Pennsylvania Department of Transportation is bringing awareness to National Work Zone Safety Week in an attempt to protect highway workers and memorialize the 22 individuals killed in work zones last year. Four of the fatalities last year were workers, 3 were PennDOT employees, and one was a contractor.

“Work Zone Awareness Week is observed each year to draw motorist’s attention to construction and utility workers who are out on Pennsylvania’s roadways. Motorists should be aware that there are municipal workers and private contractors whose ‘office’ is on Pennsylvania highways, and we ask that they drive cautiously in work zones so we can all get home safely,” said Kevin Klein, PennDOT D-2 Executive.

Last year, 1,884 accidents occurred in work zones across the country. In 2009, there were 1,519 accidents in work zones. PennDOT officials noted that since 1970, 82 PennDOT employees have been killed doing their jobs.

If you or someone you love has been the victim of an accident on the job and suffered injuries to the neck or shoulder, contact the Philadelphia neck and shoulder injury attorneys of Lowenthal & Abrams, P.C. at 610-667-7511 to set up an appointment to discuss your situation with one of our compassionate workers’ compensation lawyers.

This month, a Pennsylvania jury awarded $12.7 million to two men who were severely burned in an industrial accident. The accident occurred in 2003 at Ametek Speciality Metal Products in North Strabane.

45-year old Rudolph Andrew Paci and 44-year old James Clyde Sutch worked at Ametek as melters when a metal melting furnace exploded on September 2, 2003. After the accident, Paci was in a comma for two months, had burns on 65 percent of his body and disfigurements on 95 percent of his body. The burns destroyed his sweat and oil glands and he is no longer able to work. Sweat and oil glands help to regulate the body’s temperature and skin moisture.

Sutch suffered burns on 22 percent of his body and disfigurement on 33 percent. Doctors say he will have health complications for the rest of his life but he has been able to return to work.

In a study conducted by the University of Chicago’s National Opinion Research Center, 85 percent of workers say that their top labor concern is workplace safety. Other common concerns included maternity leave, paid sick leave, and overtime pay. Furthermore, while many of the workers said they were happy with their workplace’s safety, the majority also said they felt stressed on the job. Stressful workplaces are more likely to have accidents occur and workers injured.

Tom W. Smith, director of the survey, said that the media and public often do not pay enough attention to workers injured or lost on the job. ”Workplace safety is too often ignored or accidents taken for granted,” stated Smith.

Two AmeriCold workers were injured in a workplace accident in East Manchester Township on July 26th when a dock plate fell on top of them. Dock plates are metal ramps used to connect the gap between a truck bed and the floor of the dock. One worker was able to get out from underneath the plate and help his 23-year old co-worker, Robert Enfield.

Both men were rushed to a nearby hospital. Enfield’s head was crushed in the accident causing him serious brain injury. The other worker was treated and released not long after arriving at the hospital. On July 31st, Enfield succumbed to his injuries and passed away.

The Occupational Safety and Health Administration are investigating this tragic accident.

Our thoughts and prayers go out to Enfield’s family and friends.

In most cases, employees cannot sue their employer or co-employees for injuries related to workplace accidents. They are often limited to filing a workers’ compensation claim, which will cover their medical costs and lost wages.

There are two common exceptions, in which employees may be able to file a lawsuit. One, if the injury was the result of a defective product, the injured employee may have a case against the product’s manufacturer. And two, if the injury occurred because a co-worker intentionally harmed another employee, the injured employee may have cause for filing a civil or criminal lawsuit.
