Firefighter Wins Workers’ Compensation Case

Posted on May 27th, 2009 1 Comment

A Maryland firefighter has won a workers' compensation case. The case started when the firefighter's dog, a search and rescue K-9, ran away and returned shortly later.  When the K-9 dog returned, it has a injured leg.

After taking the dog to a veterinarian for treatment,  the vet told the woman that the dog would not be able to perform in any search and rescue operations.  The firefighter was very upset by this.  The dog was essentially the fire fighters partner.

The firefighter asked for a day off to handle the stress and cope with the situation.  The woman claims that after she asked her supervisors for the day off, they became hostile towards her.  The hostility, mixed with the loss of the dog in work, caused the woman to miss almost a month of work because of depression.

The case recently went to trial to decide if the firefighter deserved workers' compensation for the missed work, and the ruling was in her favor.

Wear Shoes Related to Work

Posted on May 22nd, 2009 1 Comment

When working many jobs, it is important to wear the proper clothing to reflect the job.  One of the most important items a worker can wear is good shoes.

The choice of shoes should reflect the job.  Good work shoes are designed to provide benefits for the job or task at hand.  Construction shoes have items inside like a steel toe that can protect against very heavy objects falling on and crushing the foot.  Some shoes for waiters or waitresses are slick resistant, to help prevent falls in the kitchen where liquids may be on the floor.  Other shoes styles include those made for comfort for individuals on their feet all day.

Whatever the case, pick the right style of shoe for the job. It might prevent an accident.

Pharmacy Spending Increases for Workers’ Compensation

Posted on May 20th, 2009 1 Comment

A recent report released indicated that the pharmaceutical costs associated with workers' compensation have increased.  Pharmaceutical costs now represent around 14% of the total medical costs that make up workers' compensation.

This increase in pharmaceutical costs represents a national trend in the increase of the costs of medicine.  The wholesale price of many popular medicines that treat injuries related to workplace accidents is one of the main reasons.  These medicines typically include medicines used to treat severe pain, anti-depression, or muscle relaxants.

Providing affordable healthcare may be a factor in reducing the overall costs associated with workers' compensation.

A construction manager that is in charge of the construction of a new arena in Louisville has come out and stated that human error was the cause of a concrete floor collapsing last month at the construction site.

It is believed that the concrete collapsed because a subcontractor involved with the construction failed to properly install support posts.

The accident injured 3 workers.  Two of the three workers have already returned back to work and only suffered minor injuries.  One of the workers however suffered a puncture to his arm.  This worker has not yet returned to work according to reports.

An official report on the accident is expected within a month.

A worker who was working on the memorial of the World Trade Center site was recently injured in an accident.  While on the job,  the man apparently slipped and fell off a deck.  The man was able to answer questions being asked of him before he was taken to a hospital. His injuries are not believed to be life threatening. The man was taken to the hospital for injuries that he had on his hips, legs, and shoulders.

The man is one of 189 workers who have been assigned to the construction World Trade Center Memorial and Museum Plaza.  After the accident, the work continued for the day.  It is not believed that the accident was caused by anything in particular, but was just a part of the risks associated with working in construction.

Some Companies Try to Avoid Workers’ Compensation

Posted on May 13th, 2009 No Comments

Although the majority of companies will care for an employee if they are injured, some companies do not like to do this.  Some companies may do their best to avoid informing an employee of their rights.  These companies may use an individual's lack of knowledge about the law to confuse them about the legal process.

In almost all cases, an individual employee will be covered if they are injured while completing a work-related job.  If you have been injured,  and the employer is refusing to help compensate you,  then you need to take immediate action.  It is important to have the process start as soon as possible so that you do not have to worry about missing any  financial obligations that you have to pay.

Pittsburgh Workers May Qualify for Compensation

Posted on May 11th, 2009 No Comments

Individuals or family members of individuals who worked in the Westinghouse Atomic Power Development Plant in Pittsburgh from 1942 to 1944 may qualify for payment from exposure to certain types of radiation.  To qualify for a lump sum payment of $150,000 dollars and certain medical expenses,  the individual or family members must show that the worker developed cancer after working at the location.

There are 22 types of cancer that would qualify an individual from receiving the lump sum cash payment.  In some cases, proof has to occur extensively, but in other cases just showing that you have the cancer will qualify an individual or their family for the payment.

Posted on May 8th, 2009 3 Comments

Four people, three of which are workers' compensation insurance agents from the American International Group, have been charged with their involvement with a $1.5 million dollar scheme.

According to reports, from August of 2003 to January of 2006 the members solicited funds from others when it should not have.  The members pretended that they had the authority to negotiate settlements regarding unpaid liens, but they did not have the authority to do so. It was also found that the individuals defrauded another company out of almost $310,000 dollars.

Man Gets 8 Months for Workers’ Compensation Fraud

Posted on May 6th, 2009 No Comments

A man has been sentenced to 8 months of jail time in Maine as a result of committing workers' compensation fraud.

While the man was collecting workers' compensation payments for an injury he sustained while working at a excavating company,  the man was also working for some hotels.  The work for the hotels was completely under the table, and allowed the man to have income from two jobs, one of which he wasn't working.

It is a shame that cases like this are used by companies to try and reduce workers' rights.

A football scout that worked for the Dallas Cowboys Football team has suffered serious injuries as a result of a practice dome collapsing.  The scout was rushed to a hospital, and it has recently been reported that the man is now paralyzed from the waist down because of his injuries.

The accident was a result of a dome practice facility of the Dallas Cowboys collapsing on several team workers.  At the time of the accident, many of the new rookies to the team were practicing.  High winds outside weakened the structure of the dome, and it soon collapsed.   Debris from the collapse landed on the scout causing the paralysis.
